Injured on Public Transport
Elderly Mrs P was nearing her stop and stood up to move forward to the front of the bus, to make sure she didn't miss her stop or hold up other passengers. Suddenly the bus driver violently braked to avoid an on-coming car performing a dangerous overtaking manoeuvre. Mrs P was thrown to the floor with sufficient force to break her nose and shoulder and required two operations to repair the injuries.
Traumatised and in a lot of pain, Mrs P came to visit us with her daughter to discuss the possibility of receiving some compensation from the bus company for the injuries she had sustained through no fault of her own.
The bus driver and the car driver blamed one another for the accident, and the bus driver also stated that Mrs P should have stayed seated until the bus came to a halt, ie she was responsible for her own injuries by having stood up.
Mrs P received 100% of the £9,000 which was awarded to her by the judge when the case went to trial.
Slippery Restaurant Floor Caused Nasty Fall
Miss S was enjoying an evening out with friends in a restaurant when she slipped on a tiled floor, breaking her wrist which left her in a lot of pain and unable to work for some time. The restaurant claimed that they were in no way to blame for the accident as the tiles they had used were described as 'non slip', and also that Miss S had been drinking alcohol and it was that factor that had caused her to lose her footing. In reality, the restaurant should have had a separate mat covering the tiles to protect their staff and customers.
Undeterred by the restaurant's initial reaction, Miss S consulted us and was awarded a settlement of £6,000 to cover her loss of earnings following the accident. As with all of our cases, Miss S kept 100% of her compensation as the restaurant's insurers paid our legal fees.
Pedestrian Suffers Life Threatening Injuries
29 year old Mr D stepped off the pavement and was knocked down by a car approaching from his right. In a horrendous catalogue of events, he was thrown 30 yards across the road with the force of the collision and whilst lying in the road was then hit by a second car, which again threw him back to the other side of the road. The driver of the second car drove away from the scene of the accident and was later traced by the police.
Mr D's injuries were so severe that paramedics were surprised to find him alive on their arrival at the accident scene. Practically every bone in his body was broken and vital organs such as his liver were also damaged. He made a satisfactory recovery considering the extent of his injuries, but the long-term prognosis for his health is not good and his earning potential has been considerably reduced.
The insurance companies of the first and the second driver both accepted responsibility for the injuries their clients (ie the drivers) had inflicted on Mr D - although it was indeed difficult to say which impact had caused the most damage. An added complication was that Mr D had stepped out in front of the first car.
Eventually, with our help, the insurance companies agreed joint responsibility and Mr D was awarded £225,000 as some compensation for his horrendous injuries and the life-long effects of his accident.
